This English version is a translation provided for convenience. The French version prevails in case of any difference.
1. Who we are
Nikographie, a business registered with the Registraire des entreprises du Québec (NEQ 2280587041). Email: niko@nikographie.ca · Phone: 450-430-0333.
2. Scope
These terms govern the use of nikographie.ca and the general principles that apply to our photography, videography and graphic design services. Each project is covered by a written quote setting out the service, price, timeline, deliverables and usage rights. If there is a difference, the accepted quote or signed contract prevails, subject to your rights under the law.
3. Quotes and contracts
- Requesting a quote is free and without obligation.
- The quote states the total price, applicable taxes, the deposit amount, the payment terms and how long it is valid.
- Your booking is confirmed when the contract is signed and the deposit is paid. You receive a copy of the signed contract.
- If you are a consumer and the contract is entered into at a distance (by email, for example), we give you the information required by Québec's Consumer Protection Act before it is entered into and send you a copy of the contract within 15 days after it is entered into.
4. Prices and payment
Prices are in Canadian dollars. No fees that are not stated in the contract will be charged to you.
5. Cancellation and refunds
See our cancellation and refund policy.
6. Performing the services
We carry out every project with prudence and diligence, following the standards of our trade. You agree to give us accurate information and, where needed, to obtain the permissions required for the shoot location. For an event, you let attendees know they may be photographed or filmed.
Delivery times and the number of included revisions are set out in the quote. We recommend you keep your own backup copies of delivered files.
7. Copyright and licences
- Nikographie is the author of the photos, videos and graphic designs it creates and keeps the copyright, unless the contract assigns it in writing.
- You receive a licence to use the work for the purposes described in the quote or contract.
- If you commissioned photos or a video for personal purposes, you may use them for private, non-commercial purposes, as the Copyright Act provides.
- For a logo or visual identity, any assignment of copyright is set out in the quote and takes effect upon full payment.
8. Use in our portfolio
We show a project in our portfolio or on social media only if the contract allows it, and we show an identifiable person only with their permission. You may refuse this use.
9. Site content
The text, photos, videos and designs on this site are protected by copyright. You may not reproduce or reuse them without our written permission. Third-party names, trademarks and logos belong to their respective owners. They identify projects Nikographie took part in and do not imply any endorsement by those owners.
10. Links to other sites
The site links to Instagram and Facebook. Those platforms have their own terms and privacy policies, which apply when you visit them.
11. Liability
Site content is provided for information purposes. We make every effort to keep it accurate and up to date.
Nothing in these terms excludes or limits our liability where the law prohibits it, including toward a consumer, for bodily or moral injury, or for injury caused by intentional or gross fault. For clients who are not consumers, our liability for a project is limited to the amount paid for that project, to the extent permitted by law.
12. Your opinion
Nothing in these terms or in our contracts prevents you from publicly expressing your opinion about our services.
13. Governing law and courts
These terms are governed by the laws of Québec and the federal laws of Canada that apply there. Any dispute falls under the courts of the judicial district of Terrebonne, which serves Mirabel (Saint-Jérôme courthouse), subject to a consumer's right to bring a claim before the court of their domicile.
14. Language
These terms are available in French and English. The French version prevails in case of any difference.
15. Changes
We may change these terms. The version published when you sign your contract is the one that applies to it.
